Privacy Policy

Effective Date: September 9, 2025

This Privacy Policy describes how Nine Pilates Inc. (“Nine Pilates,” “we,” “us,” or “our”) collects, uses, and shares information about you. This Policy applies to information we collect when you use our website, schedule or purchase services through Momence, communicate with us by email, phone, or SMS, visit our studio, or otherwise interact with Nine Pilates (collectively, the “Services”).

We may revise this Privacy Policy from time to time. If we make changes, we will update the “Effective Date” above and may provide additional notice as required by law, such as posting a statement on our website or sending you an email notification. We encourage you to review this Privacy Policy regularly to remain informed about our information practices and the ways you can protect your privacy. Capitalized terms not otherwise defined in this Privacy Policy have the meanings set forth in our Terms and Conditions.

Information We Collect

We collect personal information that you provide to us directly, including your name, email address, phone number, billing address, and payment details (processed securely through Stripe via Momence; we do not store card numbers). We may also collect health-related disclosures that you voluntarily provide, such as injuries, pregnancy, or other conditions relevant to safe participation, as well as any communications you send us by email, SMS, or otherwise. If you provide information about other individuals (for example, through referrals or guest passes), you confirm that you have obtained their consent.

In addition, we automatically collect device and browser details, IP addresses, general location information, and website usage data, including pages viewed and time spent on our site, through cookies and similar tracking technologies. We may also receive limited information from third parties, such as Momence, Stripe, or social platforms, if you interact with our advertisements or accounts.

Use of Information

We use your information to process bookings, memberships, and payments; to communicate with you regarding classes, cancellations, billing, or account matters; to send you marketing communications, subject to your consent where required by Canadian anti-spam legislation (CASL); to personalize your experience and improve our services; to administer promotions, surveys, or referral programs; to deliver and measure advertising campaigns, including through analytics tools such as Google Analytics or Facebook Pixel; and to satisfy legal, accounting, and regulatory requirements.

Consent and Choices

By providing your personal information, you consent to its collection and use as described in this Policy. You may withdraw your consent to receive marketing communications at any time by using the unsubscribe links provided in emails or by contacting us directly. You may opt out of SMS marketing by following the opt-out instructions contained in the message. Certain communications, such as class confirmations, receipts, and billing notices, are essential to your account and cannot be opted out of.

Disclosure of Information

We do not sell personal information. We may disclose personal information to Momence for class scheduling and account management, to Stripe for secure payment processing, and to third-party service providers engaged to deliver emails, SMS, or other communications. We may also share information with our professional advisors, such as lawyers, accountants, and insurers, where reasonably necessary; with authorities or regulators where required by law; and in connection with a business restructuring, merger, or sale of assets, in which case personal information may be transferred as part of the transaction. We may also use or share aggregated or de-identified data that cannot reasonably identify you for analytics or reporting purposes.

Retention and Transfers

We retain personal information for as long as necessary to provide services, maintain business records, or comply with legal obligations. You may request earlier deletion of your personal information, subject to applicable legal and business requirements. Some information may be processed outside of Canada, including in the United States, through reputable providers such as Momence and Stripe, who implement appropriate safeguards for data protection.

Security

We employ reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure. However, no system or transmission of data over the internet is completely secure, and by using our services you acknowledge the residual risks inherent in online data transmission.

Your Rights

Under Canadian privacy law, you have the right to request access to the personal information we hold about you, to request corrections or updates, to request deletion of information subject to legal or contractual limitations, and to withdraw consent to marketing communications at any time. If your privacy concerns are not resolved to your satisfaction, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada. Requests relating to your personal information should be submitted to info@ninepilates.com.
